Terms and Conditions

Asiavino is operated by Eurasia Trading Sarl, Switzerland ("we", "us", "our", the "Company"). This document applies to asiavino.com and to every country-level extension of it (the "Site", the "Platform", the "Service").

Please read these Terms before using the Service. Your access to and use of the Service is conditioned on accepting them. They apply to every visitor and user. If you do not agree with any part of them, you may not use the Service.

Using the Platform means accepting the four documents published on it, which are read together: the Terms and Conditions, the Privacy Policy, the Shipping Policy and the Refund Policy.

How the order request process works

Asiavino does not sell alcoholic beverages. Asiavino provides e-commerce and marketing services to independent third-party merchants who are duly licensed, where the law requires it, to sell alcoholic beverages in their own countries. We call them "Sellers". Every wine order placed through the Platform is fulfilled by a Seller and not by us.

The Seller responsible for your order is identified before you confirm it, for each line of your cart separately. A cart may contain wines from more than one Seller, and each line names its own.

These Terms govern your relationship with Asiavino. The Seller's own terms and policies also apply to the wine it sells you, and you are responsible for reading them. By submitting an order request you agree to comply with the policies of every Seller it is transmitted to.

Once your order request is submitted we transmit it to the Seller. The Seller may accept or reject it at its sole discretion, for any reason, including:

  • insufficient stock
  • an error in a price or a listing
  • compliance with the laws or regulations that apply to it
  • any reason set out in its own policies

If the Seller accepts, it fulfils, ships and invoices the order under its own terms. Asiavino is not a party to that sale.

What you pay for on this Platform, and what you do not

No payment for wine is taken on this Platform. There is no card form on asiavino.com for a bottle of wine, and none of our payment integrations can be reached by a wine line under any circumstances. A wine order request is transmitted to the Seller, and everything about the money for it, including the amount, the method, the currency, the invoice and any refund, is settled directly between you and that Seller.

Prices shown for wine are the Seller's prices for your market, as declared to us by that Seller. They are shown so you know what you are requesting. They are an indication of the Seller's terms and not an offer of sale by Asiavino.

Asiavino does sell a small number of things of its own, and where it does it is the seller and not an intermediary:

  • paid tickets to events Asiavino organises
  • paid documents, such as guides and reports, delivered as downloads
  • other goods sold in Asiavino's own name, such as accessories and other non-alcoholic items, which carry no drinks licence and are not sold through a Seller

For these, and only for these, Asiavino is your counterparty and the payment is taken by us through Stripe. Card details are entered on Stripe's own hosted payment page and never on asiavino.com. Your card statement carries Asiavino, correctly, because Asiavino is the seller of that item.

Some items on the Platform are free. A free document or a free ticket is ordered in the same way as a paid one and no payment is taken for it, ever.

Requests for resale

Wine may not be requested through this Platform for the purpose of resale. Resale is prohibited, both by these Terms and by the policies of the Sellers your requests are transmitted to.

Cancelling an order request

If you wish to cancel an order request, tell us within twenty-four (24) hours of submitting it, through the contact form. A request made on a Saturday or a Sunday may be handled on the next business day.

A cancellation asked for after that twenty-four (24) hour window may be considered by the Seller at its sole discretion. A request made more than seven (7) days after submission will not be considered.

An order that has already shipped cannot be cancelled, even if you tell us within the twenty-four (24) hour window. Please contact us as early as you can.

A Seller may charge a restocking fee for a cancellation made outside the twenty-four (24) hour window. Its own policies say whether it does.

A paid ticket or a paid document sold by Asiavino is not covered by the paragraphs above. The Refund Policy covers those.

Your order information

To submit an order request you must give accurate delivery and contact information. Please check it before you confirm: once the Seller has accepted the order and the cancellation window has passed, changes may not be possible, and where they are they may carry a fee.

We ask for a mobile telephone number so that the Seller's delivery service can reach you on the day of delivery.

Legal drinking age

The Service is intended only for people who are of legal drinking age where they are. By submitting an order request that contains wine, you represent that you are of legal drinking age in the market you are ordering from and that the person receiving the delivery is of legal drinking age in the destination country. Proof of age may be required on delivery.

The Platform applies an age check before a wine order request can be submitted, using the market's own minimum age. We record that the check passed, the age it computed, the minimum age it applied and when it happened. We do not copy your date of birth into that record.

An order request containing no wine carries no age check, because there is nothing to check.

Accounts

You may use parts of the Platform without an account. An account is required to submit an order request, to keep a cart between visits, to see your order history and to reach the documents you have ordered.

You are responsible for what happens under your account and for keeping your means of signing in to yourself. Tell us promptly if you believe somebody else has reached it. You may sign in with an email address and a password, or with a Google account. Signing in with Google tells us the email address, name and profile picture Google releases, and nothing else.

You may ask us to delete your account and the personal data attached to it. The Privacy Policy says how.

Accounts for merchants and distributors

Wine producers, brand owners and distributors may hold an account of their own, through which they publish and maintain their own listings, prices and availability. Those accounts are governed by these Terms and by the terms presented when the account is opened.

Some features of those accounts are offered on a paid subscription, sold by Asiavino and taken through Stripe. Where a subscription is paid, Asiavino is the counterparty and the subscription terms shown at the time of purchase apply.

A partner is responsible for the accuracy of what it publishes, including prices, availability and any claim it makes about a product. Asiavino reviews submissions before they appear publicly, and that review is editorial rather than a verification of the underlying facts.

Content on the Platform

Some descriptive text on the Platform is drafted with the help of automated tools and reviewed by a person before publication. We do not publish invented awards, scores or certifications. Where a factual claim about a wine, a producer or a certification appears, it comes from the producer, the distributor or a named source.

Tasting notes, pairing suggestions and editorial articles are opinion and are offered for information only.

Intellectual property

Unless stated otherwise, everything on the Service belongs to the Company or to its licensors, and all rights are reserved. You may not republish, sell, rent, sublicense, reproduce, duplicate or redistribute content from the Service.

Names, marks and images belonging to producers, brands and Sellers remain theirs and appear here with their agreement.

Things you submit

You are responsible for anything you submit through the Platform, including enquiries, messages and any content you publish through a partner account. Do not submit anything you do not have the right to submit.

Content submitted by users does not represent the views of the Company. We may remove anything that breaches these Terms.

By submitting content you grant the Company a non-exclusive, royalty-free licence to use, reproduce and display it for the purpose of operating the Service.

What we record when you submit something

When you submit a form on the Platform, we record, alongside what you typed, the IP address you submitted it from, your browser's user agent string, the country resolved from your connection, and the market and language of the page you were on.

By submitting a form on the Platform you accept that we record it. You may ask us in writing to delete it, and the Privacy Policy says how.

Analytics and advertising

We measure how the Platform is used and we advertise it, including through Google and Meta. Where the law where you are requires your consent first, we ask for it on the Platform and you may change your answer at any time from the cookie link in the footer. Refusing changes nothing about what the Platform does for you. The Privacy Policy describes which tools are used, what they receive, what we send them, where consent is asked for and where it is not.

Links to other sites

The Service links to sites we do not operate or control, including the sites of Sellers, producers and distributors. We are not responsible for their content or their practices, and a link is not an endorsement.

Availability and disclaimer

To the fullest extent the law permits, the Service is provided "as is" and without warranty of any kind. We do not warrant that it will be uninterrupted or free of error, and we are not responsible for the acts or omissions of a Seller.

Nothing in these Terms excludes or limits liability where the law does not permit it to be excluded or limited.

Governing law

These Terms are governed by Swiss law. The courts of the registered office of Eurasia Trading Sarl have jurisdiction, save where mandatory consumer law gives you the right to bring proceedings elsewhere.

Changes

We may revise these Terms. The version and the date in effect are shown at the top of this page. The version that applies to an order request is the one published when you submitted it. Continuing to use the Platform after a revision means accepting it.
